1. Agreement

These Terms of Service govern your use of tintocoffee.shop and any purchase you make through it. The site is operated by Melgom LLC, doing business as Tinto. By browsing this site or placing an order, you agree to these terms. If you do not agree, do not use the site.

We may update these terms at any time. The version posted at the time of your order applies to that order. Continued use after an update means you accept the revised terms.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state, to place an order. By ordering, you confirm you meet that requirement and that the payment method you use is yours or that you are authorized to use it.

3. Account Registration

You may create an account to place orders more quickly. You are responsible for keeping your login credentials confidential and for all activity under your account. Notify us immediately at [SUPPORT@TINTOCOFFEE.SHOP] if you suspect unauthorized access. We may suspend or terminate any account we reasonably believe is being used fraudulently or in violation of these terms.

4. Orders and Acceptance

Your order is an offer to buy. We accept it when we send a shipping confirmation, not when we send an order confirmation. We may refuse or cancel any order for any lawful reason, including suspected fraud, pricing errors, stock shortages, or shipping restrictions.

Because our coffee is roasted to order, we may not be able to modify or cancel an order once roasting has begun. Contact us as quickly as possible if you need a change.

5. Pricing and Payment

All prices are in United States dollars unless another currency is displayed. Prices exclude applicable sales tax, which is calculated at checkout, and exclude shipping unless otherwise stated.

Payment is processed by Shopify Payments and the third party providers shown at checkout. We do not store your full payment card details. You authorize us to charge your selected payment method for the full order total including tax and shipping.

Promotional codes and discounts cannot be combined unless expressly stated, have no cash value, and may be withdrawn at any time.

6. Shipping and Delivery

We ship within the United States. Roasted to order coffee typically ships within 48 hours of your order being placed. Merchandise items are produced on demand and ship separately, usually within 3 to 7 business days.

Delivery estimates are estimates, not guarantees. Risk of loss passes to you when the carrier takes possession of the package. We are not responsible for carrier delays, weather events, incorrect addresses supplied by you, or theft after confirmed delivery. Full details are in our Shipping Policy.

7. Returns and Refunds

Because coffee is a perishable food product, opened bags, pods, and tubes cannot be returned. If your order arrives damaged, incorrect, or defective, contact us within 14 days of delivery with your order number and photographs and we will replace it or refund it.

Unopened merchandise may be returned within 30 days in original condition. Custom and print on demand items may be non returnable except for defects. Full details are in our Refund and Return Policy, which is incorporated into these terms.

8. Subscriptions

If you enroll in a recurring coffee subscription, you authorize us to charge your payment method on the interval you select until you cancel. Prices may change with at least 14 days advance notice. You may cancel at any time from your account or by emailing us; cancellation takes effect on the next billing cycle, and orders already processed will still ship.

9. Acceptable Use

You agree not to use this site to violate any law; to resell our products without written authorization; to scrape, mine, or harvest data; to introduce malicious code; to interfere with site security or performance; or to submit false or misleading information.

10. User Submitted Content

If you submit a review, photo, comment, or other content, you grant Melgom LLC a nonexclusive, royalty free, worldwide, perpetual license to use, reproduce, adapt, and display that content for marketing and commercial purposes, with attribution to the name you supply. You confirm the content is yours to grant and does not infringe anyone's rights. We may remove any submission at our discretion. We are not obligated to keep submissions confidential or to pay compensation.

11. Third Party Services

The site relies on third parties including Shopify, payment processors, fulfillment and roasting partners, print on demand providers, shipping carriers, and email service providers. Your use of those services may be governed by their own terms. We are not responsible for their acts or omissions.

12. Disclaimer of Warranties

The site and its content are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and noninfringement. We do not warrant that the site will be uninterrupted, secure, or error free.

Nothing here limits any warranty or right that cannot be excluded under applicable law, including your rights as a consumer.

13. Limitation of Liability

To the fullest extent permitted by law, Melgom LLC and its officers, employees, and partners are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising from your use of the site or our products.

Our total aggregate liability for any claim relating to an order is limited to the amount you actually paid for that order.

Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless Melgom LLC from any claim, demand, loss, or expense, including reasonable attorney fees, arising from your breach of these terms, your misuse of the site, or your violation of any law or third party right.

15. Governing Law and Disputes

These terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute that is not resolved informally shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to the jurisdiction of those courts.

16. Severability and Waiver

If any provision of these terms is found unenforceable, the remaining provisions stay in full effect. Our failure to enforce any provision is not a waiver of that provision.

17. Entire Agreement

These terms, together with our Privacy Policy, Shipping Policy, and Refund and Return Policy, constitute the entire agreement between you and Melgom LLC regarding the site and supersede any prior understanding.
